Definitions
The term "Site" means the software and Content (defined below) made available to users by means of the Internet. The term "Content" means the text, graphics, images, information, and other material contained on the Site.
Security
Your information and our Content are stored on secure servers that are protected in controlled facilities. We require our employees and data professionals contractually to maintain the confidentiality of any information we hold. We use security technologies that are industry standard, including passwords, authentication, physical security, firewalls, and anti-virus software (which is described more fully below).
Viruses
The YMCA of Metropolitan Chicago uses appropriate commercially available anti-virus software to ensure that the Site does not contain or carry viruses. Due to the rapidly developing nature of viruses and the Internet, we strongly recommend that you employ similar anti-virus software when accessing the Site.
Personal Use Limitation
Unless otherwise specified, the Site is for your personal use. You may not modify, publicly distribute, transmit, perform, reproduce, publish, license, or create derivative works from, transfer, or sell any information, products, or services obtained from the Site.
No Unlawful or Prohibited Use
As a condition of your use of the Site, you warrant that you will not use the Site for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the Site in any manner that could damage, disable, overburden, or impair the Site or interfere with any other party's use and enjoyment of the Site. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Site.
Links to Third Party Sites
The YMCA of Metropolitan Chicago's site may contain links to other sites. We make every effort to only link to sites that share our high standards of decency, fairness, and integrity. We try our best to ensure that these links are safe for kids and appropriate for our users in general. However, since we cannot guarantee the content of every site to which we are linked, kids should always check with an adult before linking to any new sites.

IN NO EVENT SHALL THE YMCA OF METROPOLITAN CHICAGO BE LIABLE TO YOU, YOUR DEPENDENTS, OR ANYONE ELSE FOR ANY CONSEQUENTIAL, INCIDENTAL, OR SPECIAL DAMAGES ARISING OUT OF, RESULTING FROM, OR RELATING IN ANY MANNER TO THE USE OR INABILITY TO USE THE SITE, AND ANY CONTENT OR SERVICES CONTAINED THEREIN OR PRODUCTS AVAILABLE THEREON.
Cookies
The Site uses "cookies" (information stored on your computer's hard drive) to deliver Content specific to your interests and to save you time when using the features of the Site. To recognize and follow visitors, the YMCA of Metropolitan Chicago may send these cookies to a visitor's browser, which the browser stores on the visitor's hard drive. If you prefer to not use cookies, your Web browser may have a feature that allows you to eliminate them. However, if you do so, you may not be able to use all the functions of the Site.
Miscellaneous
This Agreement shall be governed by the laws of the State of Illinois, without reference to conflict of law principles. Any dispute concerning this Agreement, or any matter related in any manner to this Agreement, shall be subject to the exclusive jurisdiction of the courts of the State of Illinois. This Agreement, together with any additional online documents specifically referred to herein, is the entire Agreement between you and The YMCA of Metropolitan Chicago respectively and supersedes any other communications or advertising with respect to the Site. If any provision of this Agreement is held to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to give effect to the intent of the parties, and the remainder of this Agreement shall continue in full force and effect.
Modification of These Terms of Use
The YMCA of Metropolitan Chicago shall have the right at any time, and in its sole respective discretion, to change the Terms of Use, its terms of service, or require new terms, and to change or impose conditions on, or discontinue, any aspect or feature of the Site. Such changes shall be effective immediately upon posting of such addition, change, or deletion. You acknowledge and agree that it is your responsibility to review these Terms of Use from time to time and to be aware of any such changes.
Privacy Policy
The Information We Collect
Non-Identifiable Information
We collect information through technology to make our site more interesting and useful to you. For instance, when you come to one of our sites, we collect your IP address. An IP address is often associated with the portal through which you enter the Internet, like your ISP (Internet Service Provider). Standing alone, your IP address is not personally identifiable. At times, we also use IP addresses to collect information regarding the frequency with which our guests visit various parts of our site.
We also collect the anonymous information through the use of "cookies." A cookie is an element of data that a website can send to your browser, which may then be stored on your system. Some features of our website use cookies to better serve you when you return to our site. You can set your browser to notify you before you receive a cookie, giving you the chance to decide whether to accept it. You can also set your browser to turn off cookies. If you do so, however, some areas of our website may not function properly. Cookies do not collect or contain personally identifiable information such as you or your child's name or email address.
Personally Identifiable Information
Much of the personally identifiable information we receive comes directly from website visitors who are registering a child for camp, purchasing merchandise from our online store, inquiring about staff positions, or logging on as a parent, camper, staff member, or guest. Typically, this information includes, but is not limited to, camper registration information, staff applicant information, visitor's name, postal address, e-mail address, and telephone number.
Health Information
In the camper registration area, information relating to the health history of the camper is requested. Our guidelines with respect to health history information can be found in our Health Information Policy.
Payment Information
In order for you to purchase merchandise from our online store or provide payment for a camper's deposit and tuition, your credit card and/or bank account information will be collected to process payment. If you elect to provide payment for camper tuition via recurring payments, your credit card and/or bank account information will be retained in our secure system.
If you have completed an online transaction using a credit card, we may request your permission to retain your credit card information to simplify future transactions and make communications about past transactions. When credit card information is retained, it is kept secure (in encrypted form) and separate from other demographic information you may have given us.
How Your Information is Used
We will use the information you provide to process enrollment requests and orders, provide you with services on our website, and share product, service, or camp news and offers with you. In some cases an outside company may be contracted by us to fulfill a specific request or obligation to you. On occasion, when a related program or ministry will be in your area, you may receive notice of the event. When you make a donation to the YMCA of Metro Chicago, your information may be shared for the purpose of processing the donation, and maintaining the relationship with you.
We will never disclose any personal information collection through the course of business with any third parties except: when deemed necessary to fulfill a specific request or obligation to you; to manage, support, and market the YMCA of Metro Chicago's business and deliver Y services and/or complimentary services included as part of your relationship with the YMCA; or to comply with a valid legal process.
Our Commitment to Data Security
The security and confidentiality of your information is extremely important to us. To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, we have put in place appropriate physical, electronic, and administrative procedures to safeguard and secure the information we collect online. From time to time, we review our security procedures in order to consider appropriate new technology and methods.
The YMCA of Metro Chicago transmits confidential and personally identifiable information using 256-bit Secure Socket Layers (SSL) encryption to protect its privacy and integrity. Payment information is stored in an encrypted form in a secured database.
Our Commitment to Children's Privacy
Protecting the privacy of children is especially important. The Children's Online Privacy Protection Act (COPPA) applies to the online collection of personal information from children under the age of 13. It is designed to ensure that parents are in control over what information is collected from children under 13. Our enrollment, health history, and payment procedures require all information related to children under the age of 13 be submitted by a parent or legal guardian.
Whenever we collect such personally identifiable information in these situations, the information will be used solely by us or one of our agents or contractors for the purposes indicated at the time the child (with parental/guardian notice or consent, as applicable) provides the information. For example, if a parent registers a child, or a child registers themselves in a promotion, we will use the information to notify the child that he or she has won and to fulfill the promotion prize. We also may transfer, disclose, or share such information with third parties who are engaged by us specifically to administer or fulfill certain online activities (e.g., conducting surveys and contests). Such third parties have access to personal information needed to perform their specific functions, but may not use it for any other purposes. Lastly, we may also disclose personally identifiable information to third parties when required by law or pertinent to judicial or government investigations or proceedings, or when otherwise necessary to protect our website or the safety of its users.
Changes to this Privacy Policy
This privacy policy describes the types of information we currently collect, and the ways we use and protect that information. From time to time, we may collect different types of information and use that information in different ways - for example, when we add features or services to www.ymcachicago.org. In these cases, we may edit this policy to explain the new practices. Because protecting your privacy is very important to us, we do not expect major changes in policy. However, if we do make significant changes in our practices, we will include announcements on the www.ymcachicago.org home page so that you will know to review the revised policy.
Donor Privacy Policy
The YMCA of Metropolitan Chicago ("YMCA") respects the privacy of our donors and is committed to protecting the personal information that we gather and maintain regarding those donors. This Donor Privacy Policy ("Policy") guides YMCA and volunteers on the use of personal information pertaining to donors. The Policy applies to the collection of donor information from any source: physical donation or pledge cards, our website, membership desk, registration for an event or fundraiser, or by any other means.
As part of its Mission Advancement efforts, YMCA collects, retains, and uses donor information such as: name, address, telephone numbers, email address, spouse's name, donation amount, designations, donor history, contributions, and limited demographic information.
For accepting payment, YMCA uses a third party online payment processing service with high levels of security. YMCA does not store, nor does it have access to, credit card information knowingly provided by the donor, bank account numbers, or other account data sent to the payment processing service as part of an online donation, purchase, or registration. Credit card numbers, provided by donors through electronic means, are not retained by YMCA employees, nor do employees have access to these credit card numbers.
Credit card numbers provided by donors through any physical forms or via telephone to authorized YMCA employees are securely transmitted to the third party online payment processing service and are not retained otherwise.
YMCA uses donor information for the following purposes:
To administer and maintain records relating to donations.
To facilitate fundraising.
To communicate with donors about the YMCA.
To distribute receipts to donors.
To remind donors to honor pledges when due.
To thank donors for their support.
To provide information used in internal analysis.
To comply with legal or regulatory requirements.
YMCA will not use donor information in the following manner:
YMCA will not sell or share donor information to or with anyone else.
YMCA will not send mailings to donors on behalf of other organizations.
YMCA will not share donors' personal information with any third parties.
If any donor has indicated that his, her, or its donation is made anonymously, YMCA will honor that indication and will not identify the donor in its recognition materials.
YMCA may utilize outside vendors for various purposes related to YMCA's business. Such vendors may be given donor information for such use. These vendors sign a confidentiality agreement and are prohibited from using this information for any other purposes.
To make our website more useful to donors, volunteers, and the general community, YMCA's server automatically collects information when someone visits the website. This information includes, but is not limited to IP addresses, date and time of the visits, pages visited, and click streams.
YMCA may, at times, publicly recognize the receipt and purpose of a donor's gift. Unless the donor requests anonymity, YMCA may recognize the donor and the donor's support in its Mission Advancement materials.
YMCA reserves the right to change this Policy at any time and from time to time. The current Policy will be posted on the YMCA's website. For changes to the Policy that may be materially less restrictive on the use or disclosure of a donor's personally identifiable information, YMCA will obtain donor consents before implementing the change
For reporting purposes including grant applications, trend analysis, reporting requirements and government filings, YMCA may provide data on donors and donation amounts to third parties on an aggregated basis and on an individual basis only if stripped of all identifying information, in each case without requiring consent of the donors.
In addition to the protective measures for all data collected by the YMCA set forth above in the section titled "Our Commitment to Data Security", YMCA maintains various physical, electronic, and administrative safeguards and policies to protect donor information. These include, but are not limited to:
Restricting access to donor data;
The use of passwords for and encryption of files containing donor information; and
A written records retention policy.
